Regulation of regulations, penalties for violations of the law, in fact, are prescribed.
It is understood that the Civil Code makes clear provisions for the sole raising and management of dogs. Our city has a more detailed regulation on the regulation of urban dogs in the city.
According to articles 1234, 1246, 1247, 1249, 1250 and 1251 of the Civil Code, animal breeders who cause damage to others, those who do not take safety measures against animals who do not cause harm to others, those who prohibit the raising of dangerous animals, such as dogs, who cause harm to others during abandonment, escape, and those who cause harm to others by the fault of a third person, are responsible for violations and can prove that the damage was caused by wilful or gross negligence on the part of the victim, and may not be incurred or mitigated.
The Regulation on the Management of Dogs in the City of Jiazhou specifies that the dogkeeper or dog manager shall hold a dog by a canine rope of less than two metres; it is prohibited to hold dogs in office areas, hospitals, kindergartens, school teaching areas, student dormitories, unit collective dormitories and public areas such as building blocks, greenfields, etc.; if the dogkeeper or dog manager fails to take safety measures to cause injury to others, the victim shall immediately be brought to a medical institution for medical treatment, with the payment of medical expenses; the public security authorities shall find that the dog only hurts another person or is reported to have injured another person, and shall detain the dog and send him to an animal clinic for observation.
In violation of the provisions of the Regulations, the public security organs impose penalties for ordering modifications, fines, detention and confiscation of dogs.
Article 4, paragraph 5, of the Regulations of the Supreme People's Court on Certain Evidence in Civil Proceedings provides that: “Tort action for damage to a person caused by the raising of animals is the burden of proof on the animal breeder or manager in respect of the fault of the victim or the fault of a third person.” As can be seen, the applicable system of reversal of the burden of proof is applied to violations caused by the absence of a dog.
