At 1900 hours on 18 March 2021, as usual, Ms. Jiang returned home from work on an electric vehicle and travelled to Jiang Ho Boulevard, in the western collectivité of Nanning City, when a dog with no towed rope suddenly ran out of the opposite lane, colliding with Ms. Jiang ' s electric vehicle, causing Ms. Jiang to fall down and suffer injuries and some damage to the electric vehicle. The traffic police subsequently found the owner of the dog and issued a traffic accident certificate, which concluded that at the time of the incident the owner had not tied the dog to the leash, causing a traffic accident and that Ms. Chiang was not responsible.
After the accident, Ms. Jiang was taken to medical treatment. Ms. Jiang was diagnosed as having broken her left neck and left knee artery and was hospitalized for one week at a cost of surgery and treatment of nearly $13,000. Following this, Ms. Jiang needs to use the outside stationary for eight weeks and take a full rest period of three months. However, the owner of the dog had not paid any fee to Ms. Jiang and did not apologize to Ms. Jiang. Ms. Chiang can only sue the court for compensation for the damage caused to the owner of the dog, for medical expenses, for lost work, etc.
In accordance with article 1246 of the Civil Code of the People ' s Republic of China, animal breeders or managers are held liable for violations of the regulations, if no safety measures have been taken against animals that have caused damage to others. In the present case, the failure of Yip to tie her dog to a leash resulted in a collision between the dog and Ms. Jiang, which resulted in injuries, Ms. Jiang was found not to be responsible by the traffic police and Ms. Yip was fully liable for her losses.
The judge reminded that dog breeding must be regulated. Dogs only go out to tie to pull and do not allow them to run around public places such as roads in case of accidents. Civilized dogs are both the protection of others and the protection of dogs of love.
