Lee Ming argued that he had been licked by a dog in a convenience store and that the convenience store had to be held liable, and therefore a complaint was filed in court against Anhui Neighbors Limited for damages. In recent days, the case was decided by the Sunsan Court.

He was licked by a dog while shopping

Dogs licked it in the convenience store.

Li Ming claimed that on 12 August 2020, at about 21.45 p.m., he went to the market next to the Sun Coast to shop at the supermarket, where dogs brought to the store by other customers licked his left leg wound. He called the police and the police went to the scene. At about 23 p.m., he went to the Infectious Diseases Hospital to inject rabies and later received multiple rabies.

After the incident, Li Ming never found the owner of the dog, and he contacted the property staff and manager of the district on several occasions in an attempt to find him, but to no avail.

Lee Ming stated that during rabies he had an inflammation with tonsils, but was unable to take medicine or drink stimulating foods such as tea, coffee, tobacco and alcohol. In his view, the failure of the convenience store to take the relevant measures to prohibit the entry of pets into the store, which had resulted in him being licked by a dog, not only causing him mental suffering and loss of work, but also the long incubation of the rabies virus, had made the supermarket liable for all damages that might result from being licked by a dog, and had demanded that Anhui Neighbors Co. Ltd. pay compensation for medical fees, labour errors, moral damages, etc.

The convenience store is 70% liable.

Anhui Neighborhood Co. Ltd. argued that Li ' s loss should be borne by the direct infringer, that it was merely a supplementary liability as a mall, and that the exact amount was at the discretion of the court.

The court found that, at the time of the incident, Li Ming had not informed the staff of the supermarket and the owner of the dog, but had later reported to the police that the wound had been licked by the dog and that the owner had not been found.

The court held that Anhui's convenience store, a convenience store run by Anhui, belonged to a public place and was under an obligation to protect others from damage to persons and property to the extent reasonably possible. The company allowed others to carry pets in public places, causing them to be faulty in touching Lee Myung ' s injured leg, failing to meet their corresponding safety and security obligations, and was liable for damages.

However, Li Ming did not inform the convenience store when he was touched by a dog, resulting in the inability to find the actual perpetrator of the violation and his own fault for the damage that occurred, which could alleviate the responsibility of the perpetrator.

In the case at hand, the court determined that the convenience store was liable for 70 per cent of the loss.

As a result of this judgement, Anhui Neighborhood was awarded compensation of over $1080.
