Lawyers' interpretation
In response, counsel stated that, according to article 1246 of the Civil Code of the People's Republic of China, “in violation of regulatory provisions, an animal breeder or manager who fails to take safety measures in order to cause damage to another person shall be held liable for the violation; however, liability may be mitigated if it can be proved that the damage was caused intentionally by the victim”. Also, article 29 of the Guangzhou City Dogs Regulation specifies that “when carrying dogs for outdoor activities only, canine ropes shall be used to hold them”.
In the above-mentioned cases, the owner of the dog did not use a canine rope to hold the dog, resulting in an uncontrolled run-off in the public area of the district, causing injury to the client, Mr. Lee, and the owner should therefore be held responsible for the violation and compensate Mr. Lee for his loss.
Counsel further reminds that, as of 1 July 2009, the Guangzhou City canine regulations have been in force in Guangzhou City with clear provisions on the type, number and area of activity of dogs raised in Guangzhou City. Also on 11 October 2019, the Standing Committee of the Guangzhou City People ' s Congress issued the Guangzhou City Dog Management (Revised) Ordinance, which also shows that the city government of Guangzhou has tightened the regulations governing dog-keeping.
Therefore, counsel recommends that the majority of people who love dogs should observe the relevant regulations and regulations of the city, so that they are able to use dog ropes to hold dogs outside their homes, wear only their mouths, clean up their dung in a timely manner, and do not interfere with the normal life of others, while not raising dangerous animals such as dogs, which are prohibited by law.
If a dog is injured, the victim is required to maintain evidence in a timely manner, and immediately after the dog has been bitten, he/she should be treated and called to the police. Victims can film their pets, their owners, their injuries, their physical environment, etc. through mobile phones, maintain their own medical documents, and then search for surveillance, access surveillance videos, fix evidence and defend their rights and interests legally.
