Mr. Yang ' s wife, Sinlan, claimed that Mr. Yang, aged 52, had just returned from casual work and had driven a second-wheeled motorbike with Hebei licence plates, travelling from east to west to some part of the Hanmura River in Beijing City House, when he suddenly ran out of a yellow and black puppy, and Mr. Yang could not escape. As the husband was not wearing a helmet, he suffered severe head injury and eventually died after being rescued that night.
At the site of the incident, which was less than one kilometre before Mr. Yang ' s village, the yellow and black dogs were raised by the village ' s villagers, von Rainbow, who did not register the dogs, and at the time of the incident, the daughter-in-law Zhang Zhang Zhiqiang, who was not chained. However, the traffic department did not make any determination regarding the accident.
Mr. Yang ' s death resulted from his failure to fulfil his management obligations as a dog manager and as a companion of a dog. The Court therefore sought compensation for the death of Feng and Zhang Jie, reasonable expenses incurred by the family in dealing with the accident, moral damages, funeral expenses and maintenance for Mr. Yang ' s mother (86 years of age), amounting to over 1.57 million yuan.
In court, both Mr. Feng and Mr. Cao said that they had no opinion on Zinland's and his family's claims and that “we are willing to pay compensation, but the specific amount of compensation will comply with the Court's decision”. The judge then adjourned the trial and organized the mediation in the court.
Netizens commented: It's a responsibility to ride a motorcycle without helmets, too fast, without timely attention to the road, and without a motorcycle driver's license to say that it's a dog hiding, and if it's a kid who runs out, it's a bad idea who gets paid.
