In recent days, there have been a series of “tox dogs” in Chengdu, where a number of netizens have reported that their own pet dogs have been killed by strangers feeding unknown foods, some of which contain blades of knives, some of which contain smudges, some of which have bubbles, etc., causing mass anger and creating cyber hot spots. At the same time, similar incidents have occurred in many parts of the country, such as the successful seizure and theft of a drug dog in Zhejiang Dongyang, where 63 doses of poison were seized.
In fact, the incident of poison dogs has also occurred in Shenzhen on several occasions, as in August 2020, 11 dogs were poisoned in a few days in a district of Shenzhen. It's not too far from us to see what's happening on the Internet.
So what's the problem?
On the one hand, the Internet reports that cases of pet dog disturbance and even injury have occurred in recent years, such as dog bites of human beings without ropes, dog defecation affecting the community, and early morning and night barking. Behind these problems is the reality that civilized dogs need to be further developed.
Against this background, there is an emerging “riot violence” voice on the Internet, with some people thinking that drugs can be put to deal with dogs, so that they can “pull” the owners of dogs to hold their dogs and foster civilization. However, it is a clear reminder that such an approach would never be desirable, and could even slide from one extreme to another, into the abyss of crime.
In fact, drug-dog behaviour may involve a range of offences, most commonly as follows:
A person who poisons another person for the purpose of eating or selling, etc., may be suspected of theft. Under article 264 of the Criminal Code, the crime of theft is the theft of public and private property for the purpose of illegal possession, in large amounts or on multiple occasions, burglary, theft with a murder weapon and theft of public and private property.
As a result, theft of dogs by means of poisoning, theft of dogs at a market price of “larger amount” or multiple thefts of others would be suspected of theft.
2. A dog who has poisoned another person may be suspected of intentionally destroying property. Article 275 of the Penal Code provides for the intentional destruction of property, which shall be punishable by imprisonment for a term not exceeding three years, by detention or by a fine, if the damage is of a large or other particularly serious nature.
The pet dog falls within the category of public and private property and is a property relationship between the owner and the dog in the legal relationship, while the poisoning falls within the category of “destruction”, and the death of the dog will result in the loss or impairment of the owner's property rights or use rights, so that the pet dog who poisons another person and meets the criteria for the conviction of the offence will be held criminally liable under the law.
A person who poisons a public place will even be suspected of a crime against public safety. In fact, whatever the poison dog can justify, “tox dog” injuries are often indiscriminate, and food mixed with drugs is placed in public places such as small areas, parks, which may not only be eaten by other animals, but may even be picked up by young children and mis eaten, and the consequences would be difficult to imagine if drugs were poisons capable of “undifferently hitting” people and dogs.
At that time, the poisoning of a dog would be suspected of endangering public safety and, in accordance with the relevant provisions of the Penal Code, those who have not yet caused serious consequences would be punished by imprisonment for three to ten years, or by imprisonment for more than ten years, life imprisonment or death if they caused serious injury, death or substantial damage to public or private property.
To poison dogs is likely to be held criminally responsible, and while we strongly condemn them, we must also repeatedly remind civilized dogs. To some extent, dogs, especially in densely populated urban environments, are likely to cause distress in the lives of others. We call on dog breeders to develop civilized dog habits.
One is to wear a tow rope when walking a dog and to avoid contact with the elderly, children, pregnant women, etc.;
Second, dogs are not allowed to defecate in public places, and if they are inadvertently discharged, clean up in a timely manner;
Thirdly, in the early morning hours, if the dog screams loudly, it should be appeased in time to prevent interruption of rest.
